3.5 Development Permits

3.6 Land Consolidation

The Local Government Act authorizes municipalities to issue development permits to address issues including but not limited to the protection of development from hazardous conditions, the protection of the natural environment, ecosystems and biodiversity, the protection of farming, and the establishment of objectives for form and character. Where Development Permit Areas are designated (see Appendix 2), a development permit is required after a property's OCP designation and zoning are deemed appropriate for the proposed use, but before a building permit is issued. If a development permit is required, owners may be required to obtain the development permit prior to altering or subdividing land, or constructing, adding or altering a building or structure.

In consideration of the future development of neighbouring parcels, land consolidation may be considered to prevent the creation of remnant parcels that cannot be developed to the intended land use designation. Land consolidation can support equitable distribution of road dedication and construction, and in some cases assist development to avoid adversely impacting existing residents. If land consolidation is determined to be unachievable, the developer should, to the satisfaction of General Manager of Planning and Development:

demonstrate that the development potential of adjacent or excluded properties will not be materially compromised; and demonstrate how required transportation or servicing works will be addressed in a manner consistent with applicable bylaws, policies, and cost recovery mechanisms.

Development Permit Areas for the following are identified:

In all cases of infill development, the developer should provide a concept plan illustrating potential development scenarios for adjacent properties to demonstrate that excluded properties remain reasonably developable.

DP1: Form and Character;

DP2: Hazard Lands;

DP3: Sensitive Ecosystem; and,

DP4: Agricultural.
